When it comes to immigration policy, President Obama often seems at odds with Congress. But on one point he and lawmakers are in sync: There is broad agreement they don’t like the practice of some companies hiring workers here illegally by giving them an H-4 visa to accompany their spouses who already have legal status as H-1Bs or H-2Bs. The visas were created so foreign guest workers could bring their families along to live here temporarily until their gigs ended.
A recent Senate hearing called for a crackdown on this abuse, which critics say undermines American workers seeking skilled jobs and hurts businesses trying to follow federal rules by legally bringing people into the country.
“It should not be acceptable practice for employers to use a loophole to circumvent laws designed to protect American workers,” Senate Judiciary Committee Chairman Patrick Leahy said after the hearing. “There must be consequences for breaking our employment laws.”
As part of his budget proposal, Obama suggested limiting such visas. That sparked protests from tech company CEOs. Facebook‘s Mark Zuckerberg posted about the issue on his page, calling it harmful to America. He added his views to comments submitted to the White House by several other Silicon Valley leaders.
On Monday, Homeland Security Secretary Jeh Johnson announced the department would propose regulations that would end the practice. An announcement came after months of internal deliberations and meetings between DHS officials and business executives over how best to crack down without hampering legitimate efforts to recruit immigrants.
